Automobile Accidents
When you are injured in an automobile accident, you will need someone to help you understand your rights.
At the accident scene you should follow a number of important steps. First, move your vehicle to a safe location near the accident scene, if possible. Secondly, you should call 911 to report the accident. Ask for a Police Officer or Trooper to be sent to the accident scene to take information. Make sure to obtain from all other vehicles in the accident the following information: The license plate tag number; the name and address of the owner of each vehicle; the insurance company and policy of each vehicle. It is also important to ask the Police Officer or Trooper for his/her name, Identification Number, phone number and location of their barracks. Workers' Compensation If you are injured on the job, you need to know your rights. Here are some questions you may have:
1. When should you report your injury? As soon as possible. The Workers’ Compensation law says that you have to give Notice within 30 days of the accident, but you should tell your boss immediately. If you wait more than 30 days, your claim can be denied if your Employer can show they have been prejudiced or put at a disadvantage by the delay.
2. How long do you have to file a claim? You have 2 years from the date of the accident to file an Employee’s Claim with the Workers’ Compensation Commission, but you should not wait. You should contact Hood & Scholnick to file an Employee’s Claim right away.
3. If you file a claim with your Employer and their Insurance Company, is that sufficient?
No, you must file an Employee’s Claim with the Workers Compensation Commission located at 10 E. Baltimore Street, Baltimore, MD 21202 to protect your rights.
4. Is there a fee to file an Employee’s Claim with the Workers Compensation Commission? No, and a lawyer cannot charge you a fee to file an Employee’s Claim. All attorneys’ fees must approved be the Workers’ Compensation Commission and an attorney can only receive a fee from the benefits he has earned for you.
5. Do you have to be a United States Citizen in order to file a Workers' Compensation claim? No. If you are an employee, you can file a claim.

If you can not work due to illness or injury and you will be unable to work for a year or more, then you may be entitled to Social Security Disability. For most people, obtaining benefits is a long, exhausting process. It is important to file a claim as soon as you stop work. This is called an Application for Benefits. Most people are denied at this first step. The key thing to realize is that you MUST appeal all denials within 60 days. Therefore, you can call our office so that we can file an appeal known as a Request for Reconsideration. Once again, most applicants are denied at this second step. However, this does not mean that you cannot win your claim. The standard of review at the next step is very different than at the first two steps. Many more people are granted benefits at the second appeal. At this stage, you are entitled to a hearing and your case is heard by a Judge. This second appeal also MUST be filed within sixty days.
The most important thing to remember is to not lose hope or accept your denial. Filing an appeal within the sixty days of a denial will give you a chance to have a hearing in front of a Judge. You will need an attorney to help you through this process. Call us right after you file your claim and we will assist you through the Social Security system. We do not charge a fee unless we win your case.
